Board of Supervisors -August 8, 2019 Regular Meeting

The Wise County Board of Supervisors met in a Regular Meeting on Thursday, August 8, 2019 @ 6:00 PM in the School Board Education Center located at 628 Lake Street in Wise.  The following Board members were present:

PRAYER

Bob Adkins led in prayer.

PLEDGE

All led in the pledge of allegiance to the flag.

MINUTES

A motion was made by John Schoolcraft, seconded by Robby Robbins, to approve the minutes of June 13, 2019 and June 21, 2019 as presented.  The motion was unanimously approved.

AGENDA

A motion was made by Bob Adkins, seconded by Robby Robbins, to approve the agenda and the item in red as presented.  The motion was unanimously approved.

IN RE:  PUBLIC HEARING – TRANSPORTATION (HIGHWAY) SAFETY COMMISSION

A public hearing was duly advertised for this date to receive citizens’ comments regarding a proposed Ordinance to Rescind the Transportation (Highway) Safety Commission.

There being no public comments regarding the proposed ordinance, the public hearing was closed.

IN RE:  SOLSMART COMMUNITY DESIGNATION

Administrator Hatfield stated that Wise County has received the SolSmart Community Designation (Silver Level) that will give our regions’ leaders the tools to effectively attract solar investments (including manufacturing and storage) while maximizing local economic impact.  

PUBLIC EXPRESSION

Laura Gilliam, a resident of Duffield, addressed the Board with the struggles that are facing the coal miners that have been affected by the closure of Blackjewel  facilities when the company filed for Chapter 11 bankruptcy.  Some of the mines are located  in Virginia, Kentucky,  and West Virginia.  The employees last pay checks bounced leaving them in financial distress.  Several avenues are being taken to possibly recover the unpaid wages, but it takes time to go through the process.  She noted several organizations that have provided financial assistance to these families, which has been a blessing.  She explained that she is going to different counties and towns requesting any financial assistance that may be available to support these miners during this time of need.

There being no further public comments, the public expression period was closed.

IN RE:  CONSENT AGENDA

A motion was made by Bob Adkins, seconded by Robby Robbins, to approve the consent agenda as follows:

IN RE:  RESOLUTION  - GASB 54 FUND BALANCE

Adopted the resolution amending the Wise County Board of Supervisors GASB 54 Fund Balance

IN RE: ORDINANCE – TRANSPORTATION (HIGHWAY) SAFETY COMMISSION

A public hearing was held on 8-8-19 for public comments regarding a proposed ordinance to rescind the Transportation (Highway) Safety Commission.

Attorney Mullins explained that this Commission was created for the purpose of carrying out the guidelines of the Virginia Department of Transportation Safety in order to qualify for Federal Highway Safety Grants.  Virginia Department of Transportation has advised that such a commission is no longer mandated and no longer required to obtain Federal Grants.

A motion was made by Robby Robbins, seconded by John Schoolcraft, to approve the Ordinance  Rescinding the Transportation (Highway) Safety Commission.  The motion was unanimously approved.

IN RE:  ARC-TV CONTRACT RENEWAL

A motion was made by Bobby Cassell, seconded by Bob Adkins, to take no action on the ARC-TV Contract renewal until after close session.  The motion was unanimously approved.
IN RE:  BUDGET AMENDMENTS

A motion was made by Bob Adkins, seconded by Steve Bates, to approve budget amendments #1, #2, and #3 as presented.  The motion was unanimously approved.

IN RE:  APPOINTMENT RECREATIONAL AUTHORITY

A motion was made by Robby Robbins, seconded by Dana Kilgore, to re-appoint Debbie Baca to the Wise County Recreational Authority for a term of four (4) years.  The motion was unanimously approved.

IN RE:  APPOINTMENT SOUTHWEST VIRGINIA COMMUNITY CRIMIAL JUSTICE BOARD

Robby Robbins nominated Michael Hatfield for re-appointment to the SWV Community Criminal Justice Board as a representative for Wise County.

J. H. Rivers made a motion that nominations cease and Michael Hatfield be re-appointed by acclamation.  Bob Adkins seconded the motion.  The motion was unanimously approved.

IN RE:  APPOINTMENT WISE COUNTY TOURISM COMMITTEE

A motion was made by Fred Luntsford, seconded by Bobby Cassell, to re-appoint Sharon Lynn Hatfield to the Wise County Tourism Committee for a term of four (4) years.  The motion was unanimously approved.

IN RE:  CLOSE SESSION

A motion was made by Bobby Cassell, seconded by Bob Adkins,  to go into close session as permitted by the Code of Virginia per the following Code Sections:

                Section 2.2-3711(A)(6)  Investing of public funds
                                                  (A)(7)  Consultation with legal counsel
                                                  (A)((1)  Personnel

The motion was unanimously approved.

After a lengthy close session, a motion was made by Bob Adkins, seconded by John Schoolcraft, to reconvene the regular meeting.  The motion was unanimously approved.

IN RE:  RESOLUTION CERTIFYING CLOSE MEETING

A motion was made by Fred Luntsford, seconded by J. H. Rivers, to approve the resolution certifying that only public business matters lawfully exempted from open meeting requirements as were identified in the motion convening the close meeting were heard or discussed by the Board of Supervisors.  The motion was unanimously approved.

RESOLUTION #             -2019

IN RE:  LEASE OF VEHICLES

A motion was made by Fred Luntsford, seconded by John Schoolcraft, to authorize the County Administrator and the County Attorney to pursue a contract for leasing of a fleet of County Vehicles.  The motion was unanimously approved.

IN RE:  ARC – TV CONTRACT RENEWAL

A motion was made by John Schoolcraft, seconded by Bob Adkins, to table any action on the ARC-TV Contract Renewal to allow additional negotiations between ARC-TV and the County Administrator.

COUNTY ADMINISTRATOR’S REPORT

Administrator Hatfield gave the Board an update on the status of the Ballad Merger.  He also reported on a recent meeting he had with a representative of the Forest Service regarding High Knob Recreational Area.

BOARD COMMENTS

Board members commented on the need to focus on bringing more jobs to our area and to concentrate on our region’s resources for tourism.

ADJOURN

There being no further business to come before the Board, a motion was made by Robby Robbins, seconded by Steve Bates, to adjourn the meeting at 8:40 PM.  The motion was unanimously approved.
