Board of Supervisors - October 11, 2018 Regular Meeting

The Wise County Board of Supervisors met in a Regular Meeting on October 11, 2018 @ 6:00 PM in the School Board Education Center located at 628 Lake Street in Wise.  The following members were present:

Honorable Robert R. Adkins

Annette Underwood – Executive Secretary

PRAYER

Bob Adkins led in prayer.

PLEDGE

All led in the pledge of allegiance to the flag.

MINUTES

A motion was made by Robby Robbins, seconded by Steve Bates, to approve the minutes as presented.  The motion was unanimously approved.

AGENDA

A motion was made by Robby Robbins, seconded by John Schoolcraft, to approve the agenda as presented to include the items in red.  The motion was unanimously approved.

IN RE:  ANIMAL CONTROL  COMPLAINTS

Lisa Odle came before the Board once again to reiterate  complaints of animal cruelty against Animal Control Officer Glen Arwood, noting that she has names of all accusers and contact information.  However, no one from the County has made an effort to contact those people to verify these claims.   She said this Board of Supervisors has the authority to fire Mr. Arwood, and should with all the information that has been given regarding his position as Chief Animal Control Officer.  Claims were made that he got rid of Ms. Buchanan’s animals that were to be taken care of, and remain on her property after her death.  She spoke briefly on wishes of Ms. Buchanan that were noted in her Will regarding her animals and use of her home and property.

Yvonne Whitaker told the Board of her ordeal in trying to get her two dogs back from the animal shelter.  She kept getting the run-around from the Shelter Staff, and to date has not been able to get her dogs.   She said she was disappointed in the Board of Supervisors that Glen Arwood is still employed by the County with everything that has been brought to the Board’s attention regarding his treatment of animals.  She noted treatment of animals that were taken from her home, and the method he used to put them in his vehicle.  His attitude showed  lack of concern for the animals

Tammy Hamilton Wright spoke of several occasions that she encountered Mr. Arwood’s treatment of animals that were in poor living conditions.  She said he seem to care less about the condition of the animals, and did nothing.  Ms. Wright voiced her support for relieving Mr. Arwood of his duties
                
PUBLIC EXPRESSION

Walter Crouse a resident of the Hurricane area,  commented on the budget for the County and School Board.  He urged citizens to not litter, and to recycle paper and plastic, which will save our landfill. 

There being no further public comments, the public expression period was closed.

IN RE:  CONSENT AGENDA

A motion was made by Robby Robbins, seconded by Bob Adkins, to approve the consent agenda as follows:

IN RE:  DISPATCH POSITION – VACANT

Ratified filling the vacant Dispatch position in the Sheriff’s Department

IN RE:  FINANCE DIRECTOR – ADVERTISEMENT

Ratified advertisement for Finance Director in County Administrator’s Office

IN RE:  RESOLUTION – BEHAVIORAL HEALTH SERVICES PERFORMANCE  CONTRACT

Adopted the resolution approving the Behavioral Health Services Performance Contract

The motion to approve the consent agenda was unanimously approved.

IN RE:  PROPERTY MAINTENANCE

There was some discussion on the need for property maintenance in Wise County, which would give the Board guidance and the opportunity to remove blighted and condemned buildings.

After further discussion, a motion was made by J. H. Rivers, seconded by Robby Robbins, to set a public hearing for the December meeting to receive public comments on adoption of the 2015 Virginia Maintenance Code for Wise County.   The motion was unanimously approved.
 
IN RE:  BUDGET AMENDMENTS

A motion was made by J. H. Rivers, seconded by John Schoolcraft, to approve budget amendments #5 and #6 as presented.  The motion was unanimously approved.

IN RE:  APPOINTMENT – HEART OF APPALACHIA TOURISM AUTHORITY BOARD OF DIRECTORS

J. H. Rivers nominated Robert Bloomer to the Heart of Appalachia Tourism Authority Board of Directors.
John Schoolcraft made a motion that nominations cease and Robert Bloomer be appointed by acclamation.  Steve Bates seconded the motion.  The motion was unanimously approved.   

IN RE:  APPOINTMENTS – EMERGENCY SERVICES

A motion was made by J. H. Rivers, seconded by Robby Robbins, to appoint the following individuals to Emergency Services as noted:

Jessica Swinney .. Coordinator
Karen Mullins…Deputy Director
Tony Honeycutt… Maintenance Director

IN RE: APPOINTMENT -  LOCAL EMERGENCY PREPAREDNESS COMMITTEE (LEPC)

A motion was made by Robby Robbins, seconded by John Schoolcraft, to appoint the following individuals to the L.E.P. Committee:

A motion was made by Robby Robbins, seconded by J. H. Rivers to make the following appointments for Civil Defense:

IN RE:  APPOINTMENT - LOCAL CITIZENS CORP COUNCIL

A motion was made by John Schoolcraft, seconded by J. H. Rivers, to appoint the following individuals to the Local Citizens Corp Council:

The motion was unanimously approved.

IN RE:  CLOSE SESSION

A motion was made by Robby Robbins, seconded by Bob Adkins, to go into close session as permitted by the Code of Virginia per the following Code Sections:
                Section… 2.2-3711(A)(6)  Investing of public funds
                                                    (A)(7)  Consultation with legal counsel
                                                    (A)(1)  Personnel

Alan Harrison was invited into close session.

The motion was unanimously approved.

Following close session, a motion was made by Robby Robbins, seconded by Bob Adkins, to reconvene the regular meeting.  The motion was unanimously approved.

IN RE:  RESOLUTION CERTIFYING CLOSE MEETING

A motion was made by J. H. Rivers, seconded by Robby Robbins, to approve the resolution certifying that only public business matters lawfully exempted from open meeting requirements as were identifying in the motion convening the meeting were heard or discussed by the Board of Supervisors.  The motion was unanimously approved by roll call vote.

RESOLUTION #                2018

IN RE:  BLACKWOOD LANDFILL SEWER LINE REHABILITATION PROJECT

A motion was made by J. H. Rivers, seconded by John Schoolcraft, to award the construction bid for the Blackwood Landfill Sewer Line Rehabilitation Project to, low bidder, Natural Resource Services, Inc in the amount of $49,891.16.  The motion was unanimously approved.

IN RE:  MOU -T&L ENGINEERING SERVICE FOR BLACKWOOD LANDFILL SEWER LINE REHABILITATION PROJECT

A motion was made by Robby Robbins, seconded by John Schoolcraft, to approve MOU #18 to Retainer agreement between the Wise County Board of Supervisors and Thompson and Litton for project management and inspection services for the Blackwood Sewer Line Rehabilitation Project for a cost not to exceed $9,400.00 without Client authorization.  The motion was unanimously approved.

RECESS

A motion was made by Robby Robbins, seconded by J. H. Rivers, to recess this meeting until 12:00 Noon on Wednesday, October 24, 2018 in the conference room located in the County Administrator’s Office located in the Wise County Courthouse.  The  motion was unanimously approved.
