Board of Supervisors - June 11, 2015 Regular Meeting

The Wise County Board of Supervisors met in a Regular meeting on Thursday, June 11, 2015 @ 6:00 PM in the School Board Education Center located on Lake Street in Wise.  The following members were present:

MINUTES

A motion was made by Virginia Meador, seconded by Ronnie Shortt, to approve the minutes as presented.  The motion was unanimously approved.

AGENDA

A motion was made by Robby Robbins, seconded by J. H. Rivers, to approve the agenda as presented.  The motion was unanimously approved.

PUBLIC EXPRESSION

Dr. Jeff Perry, Superintendent of Wise County Public Schools, addressed the Board with words of thanks and appreciation for the County’s support during his tenure with the County School System, especially during the difficult consolidation period.  During that time, difficult decisions had to be made.  Together, despite periodic opposition in some areas, Wise County Schools has earned a sixth place academic ranking among all Virginia school divisions for SOL test scores and one of two divisions last year to receive full state accreditation.  Wise County schools now have a greater learning environment for our children, helping them to move forward in preparing for their future endeavors.

Dr. Perry stated that he has now accepted a position with Wythe County as its Superintendent of Public Schools, and will be facing similar challenges as Wise County.

IN RE:  PUBLIC HEARING – REZONING MOUNTAIN TRAIL REAL ESTATE

A public hearing was duly advertised for this date to receive citizens’ input on a request from Mountain Trail Real Estate LLC., to rezone approximately 4.35 acres of property located between Orby Cantrell Hwy and Wise Norton Road in Wise for the purpose of filling the lots and selling for commercial use.

There being no one to speak, the public hearing was closed.

IN RE:  PUBLIC HEARING – E-911 ROAD NAME ADDITIONS

A public hearing was duly advertised for this date to receive citizens’ input on the following proposed E-911 road name additions:
            Apache Dr… located off Redwine Rd  …requested by landowners
            Summer Dr .. located off of Russell Creek Rd in St. Paul … requested by landowners

There being no one to speak, the public hearing was closed.

IN RE:  JOINT PUBLIC HEARING –  RIDGE RUNNERS CAMPGROUND

A joint public hearing between the Wise County Board of Supervisors and the Wise County Planning Commission has been duly advertised for this date to receive citizens’ input on a request from Frank Summers for a Conditional Rezoning of approximately 22 acres of property located at 4111 Russell Creek Road in St. Paul and a Special Use Permit for a campground.

Dick Houchins, Chairman of the Wise County Planning Commission, called the Planning Commission meeting to order with the following members being present:

AGENDA

A motion was made by Roger Mullins, seconded by Shannon Scott, to approve the Planning Commission agenda as presented.  The motion was unanimously approved.

Minutes

A motion was made by J. Fred Tate, seconded by Roger Mullins, to approve the minutes of the April 2015 meeting as presented.  The motion was unanimously approved.

JOINT PUBLIC HEARING – RIDGE RUNNERS CAMPGROUND PC 15-02

Robert Mullins gave the Commissioners and Board of Supervisors background information on this case.  Frank Summers doing business as Ridge Runners Campground is requesting a Conditional Zoning and a Special Use Permit for a campground located on Russell Creek Road behind the Dominion Power Plant.  There are approximately 11 acres on one side of Russell Creek Road and another 11 acres across the Russell Creek Road where the access to the Spearhead Trail is located.  The property is currently A-RR and needs to be conditionally zoned to B-2.  Mr. Summers has an approved and bonded Pump and Haul permit with Wise County for one side of the property and has an approved septic system for a bath house on the other side of the road.  Summers has applied with VDOT for two commercial entrance permits that have not been approved at this time.  Summers currently has an Erosion and Sediment Plan in plan review. Summers has a permit from the Army Corp of Engineers for a clear span bridge and an opinion from the Corp that he should be able to remove a collapsed span bridge and a culvert and replace it with a 30 foot long by 4 foot diameter pipe with it countersunk 6 inches below the natural stream bottom, however, Summers did not put in a clear span bridge, he put in a 150 foot long by 4 foot diameter pipe and did not countersink below the natural stream bottom.  Cindy Sorrels has advised Summers to call Claire Trent of the Corp of Engineers and request approval of the way he addressed access across the stream.  Summers does not have that approval at this time. Mr. Mullins told the Commissioners and Supervisors that the Corp of Engineers and VDOT feel this will all be approved.

Frank Summers was present to address any questions or concerns that the Commission or the Board might have about this request.

Supervisor Robbins asked if the campground would accommodate RVs.  Mr. Summers said it would with a full bath house, common area, and access to the Spearhead Trail, 24 hour walking trails and primitive camping also.

Commissioner Roger Mullins and Chairman Houchins explained that with conditional zoning, Summers would be allowed use that is specific to campground and the amenities.  Robbins asked if that included a camp store and Mr. Houchins said yes.

Shannon Scott asked Robert Mullins if everything involved with this request were in order with rules and regulations and lawful, such as, with the Army Corp of Engineers and VDOT.  Mr. Mullins stated that this request for approval is only the beginning of the process and that he would be following up on every requirement.  Without everything in place, Summers will not be allowed occupancy.  Mr. Mullins said Summers has applications in for everything required for this application and has already turned away people because he understands that he must have everything approved before the campground can operate.

Dana Kilgore wanted to know what the conditions were that the Board placed on the last campground they approved.  Chairman Houchins stated that all the requirements were already required by the zoning ordinance.

There being no further questions or discussion, Chairman Houchins closed the public hearing and opened the floor for a motion.

IN RE:  RIDGE RUNNERS CAMPGROUND – CONDITIONAL REZONING & SPECIAL USE PERMIT

A motion was made by Roger Mullins, seconded by Lee Turner, to forward Case #PC15-02 to the Board of Supervisors with a recommendation to approve the conditional zoning as B-2 and a Special Use Permit for a campground for Ridge Runners Campground, LLC.  Chairman Houchins asked for a roll call vote

IN RE:  PUBLIC HEARING – STATE RT 72 IN THE NATIONAL SCENIC BYWAY

A public hearing was duly advertised for this date to receive citizens’ comments regarding the designation of State Rt. 72 from the Scenic Guest River at the northern point to the Wise-Scott County line as inclusion into the National Scenic Byway or All American Highway System by the U.S. Department of Transportation.

There being no public comments, the public hearing was closed.

IN RE:  PUBLIC HEARING – 1% INCREASE IN COUNTY’S FY 2014/15 BUDGET

A public hearing was duly advertised for this date to receive citizens’ input on a proposed change to Wise County’s FY 2014/15 budget, which totals an amount greater than 1% of the adopted Wise County FY 2014/15 budget.  The amount is $523,000 for the insurance proceeds received for the damages incurred during the recent winter storm.

There being no public comments, the public hearing was closed.

IN RE:  PUBLIC HEARING – PROPOSED COUNTY FY 2015/16 BUDGET

A public hearing was duly advertised for this date to receive citizens’ input on the proposed County FY 2015/16 budget.

There being no public comments, the public hearing was closed.

IN RE:  MECC UPDATE

Dr. Scott Hamilton, President of MECC, addressed the Board with an update on the popular Degree Programs available to help students broaden their career opportunities and secure a better paying job in their profession.  He noted that the Small Business Development Center at MECC provides one-on-one counseling, business education opportunities and resources to help small business owners or managers improve their business.  Customized training and workforce training is also available to move students forward while building character and a sense of achievement and self-confidence for their future endeavors. 

IN RE:  PLANNING DISTRICT ONE BEHAVIORAL HEALTH SERVICES UPDATE

Donna Stanley, representing Planning District One Behavioral Health Services (PD1-BHS), stated that their mission is to provide and promote quality, cost effective and community based services that will enable persons affected by mental illness, developmental disabilities and substance use disorders, to live productive and satisfying lives.

PD1-BHS, in partnership with Frontier Health, is the public provider serving Wise, Lee, Scott Counties and the City of Norton.  Steps are taken to help individuals achieve the best possible outcome in health, wellness, recovery and independence.

Approved the CIP Plan for FY 2016 as presented

The motion to approve the consent agenda was unanimously approved.

IN RE:  RESOLUTION STATE RT 72 NATIONAL SCENIC BYWAY SYSTEM

A public hearing was held on June 11, 2015 for public input on the inclusion of State Rt. 72 in the National Scenic Byway.  There was no public opposition to this request.

A motion was made by Ronnie Shortt, seconded by Virginia Meador, to approve the resolution requesting the Virginia Department of Conservation and Recreation, the Virginia Department of Transportation and the Commonwealth Transportation Board to designate State Rt 72 for  inclusion in the National Scenic Byway System.  The motion was unanimously approved

IN RE:  E-911 ROAD NAME ADDITIONS

A public hearing was held on June 11, 2015 to receive citizens input on the proposed E-911 road names additions --  Apache Dr located off Redwine Road in Wise, and Summer Trl located off Russell Creek Road in St. Paul.  There was no public opposition to the road names.

A motion was made by Robby Robbins, seconded by Dana Kilgore, to approve the E-911 road name additions as presented.  The motion was unanimously approved.

IN RE:  RIDGE RUNNERS CAMPGROUND, LLC

A joint public hearing was held on June 11, 2015 between the Wise County Planning Commission and the Board of Supervisors to receive public input on a request from Frank Summers for a Conditional Rezoning of approximately 22 acres of property and a Special Use Permit for a campground located at 4111 Russell Creek Road in St. Paul.  There was no public opposition to this request.

Supervisor Kilgore asked if Mr. Summers has provided rules and regulations for campground users as were approved by the Board for the previous campground.

Mr. Summers stated that he has made his rules more restrictive than those of the previous campground.  He briefly reviewed the list and said he had worked with Spearhead Trails to develop the campground rules.

Attorney Mullins noted that Mr. Summers has provided a list of those rules and regulations for record.

A motion was made by Robby Robbins, seconded by Dana Kilgore, to approve the request from Frank Summers for a Conditional Rezoning and a Special Use Permit for Ridge Runners Campground as requested.  The motion was unanimously approved.

IN RE:  COUNTY’S FY 2014/15 BUDGET INCREASE

A public hearing was held on June 11, 2015 to receive citizens’ input on an increase to Wise County’s FY 2014/15 budget totaling an amount greater than 1% of the adopted FY 2014/15 budget.  The amount is $523,000 for the insurance proceeds received for the damages incurred during the recent winter storm.  There was no public opposition to this increase.

A motion was made by Robby Robbins, seconded by Ronnie Shortt, to approve the $523,000 increase in the FY 2014/15 budget as presented.  The motion was unanimously approved.

IN RE:  RECESSED MEETING – TIME & DATE

A motion was made by J. H. Rivers, seconded by Robby Robbins, to recess this meeting until Monday, June 22, 2015 @ 6:00 PM.  The motion was unanimously approved.

IN RE:  GLAMORGAN CHAPEL ROAD RELOCATION

Attorney Mullins stated that she has reviewed the Plat from VDOT on the proposed relocation of the Glamorgan Chapel road and finds it acceptable and in order.  Upon completion, the new road will be accepted into the Secondary System by VDOT and the portion abandoned will be given to the original property owners (Glamorgan Chapel Church).

A motion was made by J. H. Rivers, seconded by Ronnie Shortt, to approve the Plat from VDOT regarding the relocation of the Glamorgan Chapel road as requested.  The motion was unanimously approved.

IN RE: SCHOOL RESOURCE OFFICER GRANT

Finance Administrator Cox stated that he has received a request from the Sheriff’s Department to apply for a School Resource Officer (SRO) Grant.  The total amount of the salary and benefits would be approximately $50,000 and would be funded 75% in the first year with a declining amount the following two years and in the fourth year would have to be fully funded by the County for at least one year. Mr. Cox further noted that the County is requesting an economic hardship in applying for the grant.  If this hardship is approved, and the grant received, three years of the position could be fully funded.

A motion was made by Ronnie Shortt, seconded by Steve Bates, to authorize the Sheriff’s Department to apply for the SRO Grant as presented.  The motion was unanimously approved.

IN RE:  BUDGET AMENDMENTS

A motion was made by Dana Kilgore, seconded by Steve Bates, to approve budget amendments #29 & #30 as presented.  The motion was unanimously approved.

IN RE:  APPOINTMENT – PLANNING COMMISSION

A motion was made by Fred Luntsford, seconded by Ronnie Shortt, to table the appointment to the Planning Commission until the July meeting.  The motion was unanimously approved.

IN RE:  CLOSE SESSION

A motion was made by J. H. Rivers, seconded by Robby Robbins, to go into close session as permitted by the Code of Virginia per the following Code Sections:
            Section 2.2-3711(A)(6)  investing of public funds
                                     (A)(7)  consultation with legal counsel
                                     (A)(1)  personnel

The motion was unanimously approved.

After close session, a motion was made by Fred Luntsford, seconded by Ronnie Shortt, to reconvene the regular meeting.  The motion was unanimously approved.

IN RE:  RESOLUTION CERTIFICATION FOR CLOSE MEETING

A motion was made by Fred Luntsford, seconded by J. H. Rivers, to approve the resolution certifying that only public business matters lawfully exempted from open meeting requirements as were identified in the motion convening the close meeting were discussed or heard by the Board of Supervisors.  The motion was unanimously approved by roll call vote.

A motion was made by Ronnie Shortt, seconded by Steve Bates, to recess the meeting until Monday, June 22, 2015 @ 6:00 PM.  The motion was unanimously approved.
