Board of Supervisors - May 23, 2013 Regular Meeting

The Wise County Board of Supervisors met in a Regular meeting on May 23, 2013 @ 6:00 PM in the Board of Supervisors meeting room located in the Wise County Courthouse.  The following members were present:

PRAYER

Randy Carter, Pastor Pyle’s Memorial Freewill Baptist Church, in Pound led in prayer.

PLEDGE

All led in the pledge of allegiance to the flag.

MINUTES

A motion was made by Virginia Meador, seconded by Ronnie Shortt, to approve the minutes as presented.  The motion was unanimously approved.

AGENDA

A motion was made by Fred Luntsford, seconded by J. H. Rivers, to approve the agenda as presented to include items in red.  The motion was unanimously approved.

IN RE:  PUBLIC HEARING SIX YEAR PLAN FOR FY 2014-2019

A joint public hearing between the Virginia Department of Transportation and the Board of Supervisors of Wise County, Virginia was duly advertised for this date for the purpose of receiving public comment on the proposed Secondary Six-Year Plan for FY 2014-2019 in Wise County and on the Secondary System Construction Budget for FY 2013/14.

Jackie Christian, Maintenance Operations Mgr. for VDOT, reviewed the proposed Secondary Six-Year Plan for FY 2014-2019 by line item and the proposed Secondary System Construction Budget for FY 2013/14.

There being no public comments, the public hearing was closed.

IN RE:  PUBLIC HEARING COUNTY FY 2013/14 BUDGET

A public hearing was duly advertised for this date to receive citizens input regarding the County’s proposed FY 2013/14 budget.

There was some discussion among Board members regarding old buildings that have been condemned but not removed, and those that are safety hazards, which need to be demolished and removed.   Possible options were discussed.

Walter Crouse, a resident of the Hurricane section of Wise County, expressed the same concerns as were discussed by the Board regarding old buildings as being safety hazards and a blight for tourism.

There being no further public comments, the public hearing was closed.

PUBLIC EXPRESSION

Walter Crouse, a resident of the Hurricane section of Wise County, expressed his concerns regarding the following:

  • County / school budgets

  • Loss of jobs

  • Need for cuts in School Board Administrative staff

  • Litter control

Mark Salyer, representing the Appalachia Children’s Theatre, thanked the Board for their continuous support, which has allowed them to continue with programs in the schools as an outreach to the children.  He reviewed the activities and programs that are being provided by ACT and the difference that has been seen in the children.

There being no further comments, the public expression period was closed.

IN RE:  CONSENT AGENDA

A motion was made by Ronnie Shortt, seconded by Virginia Meador, to approve the Consent Agenda as follows:

IN RE:  RESOLUTION AIRPORT ROAD (Rte. 723) PROJECT ADJUSTMENTS

Approved the resolution on the Airport Road (Rte. 723) project adjustments
 
RESOLUTION # 19-2013

(Said resolution is on file in the County Administrator’s Office)

IN RE:  RESOLUTION SECONDARY SIX YEAR PLAN / CONSTRUCTION BUDGET

A joint public hearing was held on May 23, 2013 between VDOT and the Wise County Board of Supervisors on the Secondary Six-Year Plan for FY 2014-2019 and the Secondary System Construction Budget for FY 2013/14 to receive citizens input on said Six Year Plan and Secondary System Construction Budget. 

There were no public comments regarding neither the proposed Secondary Six Year Plan nor the Secondary System Construction Budget.

Approved the resolution on the Secondary Six-Year Plan (FY 2012-2019) & Secondary System Construction Budget for FY 2013/14

IN RE:  PROCLAMATION FOSTER CARE MONTH

Approved the Proclamation proclaiming the month of May as Foster Care Month in Wise County

IN RE:  ORDINANCE ON COAL, GAS & OIL MINERAL SEVERANCE LICENSE TAX /AMENDMENT

Set public hearing (6:00 PM June 13, 2013) on a proposed amendment to the Coal, Gas, and Oil Mineral Severance License Tax Ordinance #1-2012

The motion to approve the consent agenda was unanimously approved.

IN RE:  ORDINANCE PROHIBITING SALE OF SYNTHETIC DRUGS

A motion was made by Fred Luntsford, seconded by Virginia Meador, to set a public hearing (6:00 PM June 13, 2013) on a proposed Ordinance Prohibiting Sale of Synthetic Drugs.  The motion was unanimously approved.

IN RE:  COUNTY FY 2012/13 BUDGET AMENDMENT

A motion was made by Dana Kilgore, seconded by Steve Bates, to set a public hearing (6:00 PM June 13, 2013) on an amendment to the County’s FY 2012/13 budget for school construction capital outlay in the amount of $3,800,000, which is due to the advance progress of the school construction projects.   The motion was unanimously approved.

IN RE:  COUNTY AUDIT

A motion was made by Robby Robbins, seconded by Dana Kilgore, to approve the County Audit ending June 30, 2012.  The motion was unanimously approved.

IN RE:  CROOKED ROAD BOARD OF DIRECTORS ( ALTERNATE)

A motion was made by Virginia Meador, seconded by J. H. Rivers, to appoint Michael Wampler as an alternate for Shannon Scott on the Crooked Road Board of Directors.  The motion was unanimously approved.

IN RE:  BOARD MEETING DATE CHANGE FOR JULY

A motion was made by Robby Robbins, seconded by Dana Kilgore, to change the July Board meeting date from July 11, 2013 to July 15, 2013 @ 6:00 PM.  The motion was unanimously approved.

IN RE:  BUDGET AMENDMENTS

A motion was made by Ronnie Shortt, seconded by Dana Kilgore, to approve budget amendments #25 thru #31 as presented.  The motion was unanimously approved.

IN RE:  APPOINTMENT APPALACHIAN COMMUNITY ACTION & DEVELOPMENT AGENCY BOARD

J. H. Rivers nominated Mike S. Abbott to fill the unexpired term of Michael D. Kilgore on the Appalachian Community Action & Development Agency Board.

Ronnie Shortt made a motion that nominations cease and Mike S. Abbott be appointed by acclamation.  Steve Bates seconded the motion.  The motion was unanimously approved.

IN RE:  APPOINTMENT SOCIAL SERVICES BOARD

A motion was made by Robby Robbins, seconded by Dana Kilgore, that J. D. Cassell be re-appointed to the Social Services Board for a term of four (4) years.  The motion was unanimously approved.

A motion was made by Virginia Meador, seconded by J. H. Rivers, to re-appoint Diane R. Abbott to the Social Services Board for a term of four (4) years.  The motion was unanimously approved.

IN RE:  PLANNING FOR FUTURE

There was some discussion on updating the Comprehensive Plan in connection with future budgets to achieve growth within the County with proper planning and funding.

 Supervisor Kilgore suggested having a Workshop sometime in the future to include individuals of special interests to move the County forward.

Administrator Scott noted that LENOWISCO and/or VACo would be a good choice to sit in on a planning session for their input and expertise in this field.

Supervisor Rivers suggested having Building & Zoning Administrator Robert Mullins to attend the June meeting to give the Board a status update on the existing Comprehensive Plan.

The meeting reconvened at 7:25 PM

IN RE:  CLOSED SESSION

A motion was made by Virginia Meador, seconded by Robby Robbins, to go into closed session per Section 2.2-3711(A)(6) for investing of public funds as permitted by the Code of Virginia.  The motion was unanimously approved.

After closed session, a motion was made by Dana Kilgore, seconded by Ronnie Shortt, to reconvene the regular meeting.  The motion was unanimously approved.

IN RE:  CLOSED SESSION CERTIFICATION

Secretary Underwood read the certification for closed meeting.

A motion was made by Ronnie Shortt, seconded by J. H. Rivers, to approve the resolution verifying matters discussed while in closed session.  The motion was unanimously by roll call vote.

BOARD COMMENTS

Board members encouraged citizens to participate in the summer events throughout Wise County.   Some members noted that they are still receiving requests from citizens regarding the loss of the Kentucky TV station.

ADJOURN

There being no further business, a motion was made by Ronnie Shortt, seconded by Robby Robbins, to adjourn the meeting.  The motion was unanimously approved.
