The Wise County Board of Supervisors and the Wise County Planning Commission met in a joint public hearing on Monday, August 13, 2012 at 5:00 PM regarding a request from the Wise County School Board for a Conditional Zoning Permit and a Special Use Permit to build a new high school behind the Norton Commons (Wal-Mart) Shopping Center.

CALL TO ORDER

The meeting was called to order at 5:00 PM

AGENDA

A motion was made by Dana Kilgore, seconded by Steve Bates, to approve the agenda as presented.  The motion was unanimously approved.

IN RE:  PUBLIC HEARING –CONDITIONAL ZONING/SPECIAL USE PERMIT SCHOOL SYSTEM

A joint public hearing between the Wise County Board of Supervisors and the Wise County Planning Commission was duly advertised for this date to receive citizens’ comments regarding a request from the Wise County School Board for a Conditional Zoning Permit and a Special Use Permit to build a new high school behind the Norton Commons (Wal-Mart) Shopping Center.

Building and Zoning Administrator Robert Mullins explained that Conditional Zoning allows the applicant to place exactly what structures and accessories uses on a piece of property as designed by the site plan.  The Building and Zoning Department has reviewed and spoken to several consultants regarding the Central High School site plan.  He noted that all recorded documents are in place in the Circuit Court Clerk’s Office regarding this property for the Wise County Planning Commission to make a recommendation to the Board of Supervisors on the Conditional Zoning request.  The Conditional Zoning will be for an R1 and that solely represents the 12 plus acres only of the entire property.  It will not be grouped in a district where there are other permitted uses.  The Conditional Use is allowed only for that use for the duration of the property unless a change is made, which at that point would have to be brought back before the Wise County Planning Commission and the Board of Supervisors.  The Wise County Planning Commission will not receive any applications regarding the other property since it is located in the City of Norton.
 
Regarding the Special Use Permit, Mr. Mullins explained that this permit allows what will be done within the frame work of the meets and bounds of the property.  The design for this property, the Central High School site, has been submitted to the Building and Zoning Department by Maxim Engineering.  The entire 12 acres of property is mostly covered by the school structure itself, the parking areas, accessories easements, and road ways for utilities.

Terry Collier, representing Maxim Engineering, explained the road situation leading to the school.  There have been discussions with the City of Norton regarding this road and Norton will be issuing the entrance or the driveway permit from Industrial Drive.  The decision has not been made as to whether or not the road from Industrial Drive to the school will be a VDOT maintained road.  Mr. Collier briefly reviewed the proposed Rt. 757 Project explaining how it will enhance the entrance to the school from the Barnett property side.     

Supervisor Rivers understood that the total acreage purchased is not located within Wise County but a portion of it is in the City of Norton.  He asked if the portion in the City is zoned.

Zoning Administrator Mullins stated that it is zoned in the City’s zoning map as an industrial area.  He further noted that 20 plus or minus acres are located within the City in that industrial area.

Supervisor Rivers questioned whether or not there would be a boundary adjustment to this 20 plus or minus acres of the property.

Mr. Mullins stated that the possibility of a boundary adjustment was discussed at the last Planning Commission meeting since this portion of the property is located in the City and falls under the City ordinances.  To make this property more complete for future use by the school system, steps must be taken to secure that boundary adjustment.  He noted that at this point in time he feels a sense of urgency to pursue this issue and complete the boundary adjustment.

There was some discussion on the steps that need to be taken to expedite this process.

It was noted that the City of Norton has been very cooperative during the process of site preparation for the school.

Mr. Collier commented on the compaction process that was done on the property and the traffic study that was done by Ramey Kemp Engineering Firm.

Supervisor Rivers voiced his frustration with the way the School Board has handled the purchase of the Central High School property and the work that has been done prior to this public hearing.

There being no further public comments, the public hearing was closed.

IN RE:  CONDITIONAL ZONING PERMIT – CENTRAL HIGH SCHOOL

A public hearing was held on August 13, 2012 regarding the request from the Wise County School Board for a Conditional Zoning Permit for the new high school to be located behind the Norton Commons (Wal-Mart) Shopping Center.  There was no public opposition to the proposed permit.

Chairman Adkins noted that the Conditional Zoning Permit was approved by the Planning Commission and forwarded to the Board of Supervisors with a recommendation for approval.

A motion was made by Dana Kilgore, seconded by Ronnie Shortt, to approve the Conditional Zoning Permit for the new Central High School location behind the Norton Commons (Wal-Mart) Shopping Center as requested by the Wise County School.  The motion was unanimously approved.

IN RE:  SPECIAL USE PERMIT – CENTRAL HIGH SCHOOL

A public hearing was held on August 13, 2012 regarding a request from the Wise County School Board for a Special Use Permit for the new high school to be located behind the Norton Commons (Wal-Mart) Shopping Center.  There was no public opposition to the proposed permit.

Chairman Adkins noted that the Special Use Permit was approved by the Planning Commission and forwarded to the Board of Supervisors with a recommendation for approval.

A motion was made by Ronnie Shortt, seconded by Steve Bates, to approve the Special Use Permit for the new Central High School location behind the Norton Commons (Wal-Mart) Shopping Center as requested by the Wise County School Board.  The motion was unanimously approved.

ADJOURN

A motion was made by Ronnie Shortt, seconded by Steve Bates, to adjourn the meeting.  The motion was unanimously approved.
