Board of Supervisors - July 12, 2007 Regular Meeting

The Wise County Board of Supervisors met in a Regular meeting on Thursday, July 12, 2007 at 6:00 p.m. in the Board of Supervisors meeting room located in the Wise County courthouse.  The following were present:

PRAYER

T. G. Branson led in prayer.

PLEDGE

All led in the pledge of allegiance to the flag.

MINUTES

A motion was made by Leland Branham, seconded by Fred Luntsford, to approve the minutes as presented.  The motion was unanimously approved.

IN RE:  AGENDA

It was noted that the presentation by Dominion Energy scheduled for this meeting has been cancelled and rescheduled for the August 9 meeting.

A motion was made by Bob Adkins, seconded by John Peace, to approve the agenda as presented with said deletion.  The motion was unanimously approved.

IN RE:  PUBLIC EXPRESSION

 Paul Kuczko, Director Lonesome Pine Office on Youth, provided Board members with a CD of the Mining Songs from the Appalachian Coalfields as an addition to Wise County’s Sesquicentennial celebration.

Larry Bush, a resident of the Exeter area, voiced his concern regarding strip mining and its destruction of our mountainous area and its wild life.  He stated that deaf ears have been turned to the enforcement of strip mining laws and the citizens, especially in the Appalachia area, are suffering the consequences.  The citizens are not against the mining operations.  They are asking for solutions to control the dust, the mud, the speed of the truckers and reclamation of the land that has been stripped.  He recommended that a County police officer be hired for the sole purpose of monitoring the speed of the coal trucks which would make the highways in those areas safer.

There were brief comments regarding the proposed coal fired plant and the pollutants that would be disbursed into the air and ground water.

There being no further comments, the public expression period ended.

IN RE:  ROADS & HIGHWAYS

Highway Residency Administrator T. G. Branson asked the Board for a letter of support regarding the relocation of Rt. 655.  The relocation is in conjunction with the construction of the power plant at Virginia City by Dominion Energy.  Mr. Branson explained the purpose for relocating the road and steps to be taken by the Board as the project progresses.

Chairman Shortt asked to see the plans for the relocation of the road.

It was the consensus of the Board to authorize Administrator Skinner to prepare a letter of support per Mr. Branson’s request with formal action being taken at the August meeting.

Regarding the temporary closing of Rt. 610, and due to the widening of the project, a letter of support or a resolution is needed from the Board supporting that closing.  A public hearing can be held if the Board so desires. 

Chairman Shortt stated that the County Administrator and the County Attorney will work with Mr. Branson to prepare the necessary documents to address this request.

It was the consensus of the Board to authorize the County Attorney & the County Administrator to work with Mr. Branson & set a public hearing for the temporary closing of Rt. 610.

IN RE:  RESOLUTION – WATCH FOR CHILDREN- RT. 637

A motion was made by Fred Luntsford, seconded by John Peace, to adopt the resolution approving “Watch for Children” signs to be placed on Rt. 637 on the Right Hand Fork of Bold Camp.  The motion was unanimously approved.

IN RE:  RESOLUTION – WATCH FOR CHILDREN – RT. 1403

A motion was made by Bob Adkins, seconded by Leland Branham, to adopt the resolution approving “Watch for Children” signs to be placed on Rt. 1403 on Pendleton Road.  The motion was unanimously approved.

IN RE:  RESOLUTION – SCHOOLHOUSE HILL TRAFFIC

A motion was made by Steve Bates, seconded by Robby Robbins, to adopt the resolution supporting VDOT’s proposal on the dangerous traffic situation on Schoolhouse Hill in Coeburn.  The motion was unanimously approved.

IN RE:  CONSENT AGENDA

A motion was made by Leland Branham, seconded by Virginia Meador, to approve the consent agenda as follows:

IN RE:  APPROPRIATIONS – FIRST QUARTER

The First Quarter Appropriations were approved.

IN RE:  NATIONAL GUARD AND RESERVE

The Statement of Support for the National Guard & Reserve was approved.

IN RE:  RESOLUTION EMERGENCY OPERATIONS PLAN

The resolution adopting the Wise County Emergency Operations Plan was approved.

The motion to approve the consent agenda was unanimously approved.

IN RE:  ORDINANCE – DISPOSITION OF UNCLAIMED PROPERTY- SHERIFF

A public hearing was held on July 5 to receive citizens’ comments regarding a proposed ordinance for the disposition of unclaimed property in the possession of the Wise County Sheriff.  There was no opposition to the proposed ordinance.

A motion was made by Steve Bates, seconded by Robby Robbins, to approve the Ordinance for Disposition of Unclaimed Property in Possession of Wise County Sheriff.  The motion was unanimously approved.

IN RE:  CONDITIONAL CHANGE OF ZONING / SPECIAL USE

A public hearing was held on July 5 to receive citizens’ comments regarding a request from Tommy Muncy for a Conditional Change of Zoning and Special Use Permit for property located off Orby Cantrell Hwy / Riner School Road in the Pound area for the purpose of constructing a tract for a commercial motocross /dirt bike racing track.

There was no opposition to the request.

A motion was made by John Peace, seconded by Virginia Meador, to approve the request from Tommy Muncy for a Conditional Change of Zoning and a Special Use Permit for constructing a tract for a commercial motocross/ dirt bike racing track.  The motion was unanimously approved.

IN RE:  CONDITIONAL CHANGE OF ZONING / ALLEYWAY

A motion was made by John Peace, seconded by Virginia Meador, to set a public hearing on August 2 @ 6:00 p.m. in the Board of Supervisors meeting room to receive citizens’ comments regarding a request for a Conditional Change of Zoning and Alleyway abandonment.  The motion was unanimously approved.

IN RE:  TREASURER’S / DESTROY DELIQUENT PAID TAX TICKETS

A motion was made by Fred Luntsford, seconded by Steve Bates, to authorize the Treasurer to destroy paid personal property tax tickets (January 2000 thru December 2001) and real estate tax tickets (January 2000 thru December 2001).

IN RE:  APPOINTMENT / BOARD OF ZONING APPEALS

A motion was made by Fred Luntsford, seconded by Ronnie Shortt, to table this appointment until next month.  The motion was unanimously approved.

IN RE:  APPOINTMENT / COMMUNITY CRIMINAL JUSTICE BOARD

A motion was made by Fred Luntsford, seconded by Leland Branham, to reappoint Shannon C. Scott to the Community Criminal Justice Board as a County representative.  The motion was unanimously approved.

IN RE:  APPOINTMENT / DUFFIELD DEVELOPMENT AUTHORITY

Virginia Meador nominated Blake Wilson for reappointment to the Duffield Development Authority.

John Peace made a motion to close nominations.  Virginia Meador seconded the motion.  The motion was unanimously approved.

Blake Wilson was reappointed to the Duffield Development Authority by acclamation.

John Peace nominated Ron Prewitt for reappointment to the Duffield Development Authority.

Bob Adkins made a motion that nominations cease.  Leland Branham seconded the motion.  The motion was unanimously approved.

Ron Prewitt was reappointed to the Duffield Development Authority by acclamation.

IN RE:  APPOINTMENT / HIGHWAY SAFETY COMMISSION

A motion was made by Leland Branham, seconded by Robby Robbins, to reappoint Tony Bates to the Highway Safety Commission.  The motion was unanimously approved.

IN RE:  APPOINTMENT / LENOWISCO BOARD OF DIRECTORS

A motion was made by Virginia Meador, seconded by John Peace, to reappoint Ben Allen to the LENOWISCO Board of Directors.  The motion was unanimously approved.

IN RE:  APPOINTMENT / RECREATIONAL AUTHORITY

A motion was made by Leland Branham, seconded by Fred Luntsford, to appoint Debbie Boca to the Recreational Authority.

Robby Robbins made a substitute motion to reappoint David Hileman to the Recreational Authority.  Bob Adkins seconded the motion.

The following vote was taken on the substitute motion to reappoint David Hileman.

Motion failed.

The following vote was taken on the main motion to appoint Debbie Boca.

Motion carried.

IN RE:  APPOINTMENT / LONESOME PINE YOUTH SERVICES BOARD

Chairman Shortt nominated Rachel Bentley to fill the unexpired term of Phillip Marshall on Lonesome Pine Youth Services Board.

Bob Adkins made a motion that nominations cease.  Fred Luntsford seconded the motion.  The motion was unanimously approved.

Rachel Bentley was appointed to the Lonesome Pine Youth Services Board by acclamation.

BOARD COMMENTS

There were brief comments from Board members.

Supervisor Luntsford stated that the residents of Appalachia are suffering with the coal dust, the air pollution, and the speeding coal trucks.  The citizens only request that the truckers obey the speed limit and make an effort to control the dust and mud on the highway.  He asked that the Sheriff’s Office be contacted for possible assistance with the enforcement of the speed limits.

There being no further business, a motion was made by Fred Luntsford, seconded by John Peace, to adjourn the meeting.  The motion was unanimously approved.
