Board of Supervisors - October 2, 2003 Workshop Meeting

The Wise County Board of Supervisors met in a Workshop meeting on October 2, 2003, at 6:00 PM in the Board of Supervisors meeting room located in the Wise County courthouse.  The following were present:

PRAYER

Kenny Robinson led the Board in prayer.

 

PLEDGE ALLEGIANCE TO THE FLAG

All did the pledge of allegiance to the flag.

 

IN RE:  APPROVAL OF AGENDA

Chairman Stallard read the following items to be added to the agenda:

1) Resolution approving financing terms for the new animal shelter

2) Approve Lease Agreement for new animal shelter

3) Approve Closing Certificate for new animal shelter

4) Resolution approving financing terms for purchase of eleven (11) vehicles

5) Approve Lease Agreement for the vehicles purchased

6) Approve Closing Certificate for the vehicles purchased

7) Resolution expressing support for a Federal tobacco allotment buy-out program (requested by Mecklenburg County)

Edgar Mullins asked that the Resolution approving financing terms for purchase of eleven (11) vehicles be placed under new business for discussion.

Chairman Stallard noted that proposed Special Use Permit for an adult assisted living facility to be located at 14510 Sandy Ridge road  has been withdrawn by applicant Judy Hamilton.

Betty Cornett asked that the proposed MOU for the Riverview Sewer System be deleted from the Agenda.  She asked that Attorney Mullins elaborate on this subject.

Attorney Mullins stated that she has spoken with PSA Attorney Bud Phillips and they are in the process of reviewing some documents dated l991 as to ownership and operations of the system.  She said it would be appropriate to set this item over to the next meeting to allow further study of the agreement signed in l991.

Ms. Cornett asked said she had spoken with several people today regarding the proposed Special Use Permit for a recycling/junk yard business to be located at 2314B Preston Road in the Big Stone Gap area.  She asked that the County Attorney elaborate on the study from EMI.

Attorney Mullins stated that information has been provided to members of the Board that this may be a "karsed" area and the question has been raised as to whether or not tests should be done to determine the quality of the land located around this proposed site.  It is Attorney Mullins' understanding that EMI may have been contacted regarding a test study in that area.

Ms. Cornett asked that the Special Use Permit for the proposed recycling/junk yard business be removed from the agenda for further information.

 

IN RE:  PUBLIC HEARING - SPECIAL USE PERMIT/HORSE TRAINING FACILITY

A public hearing was duly advertised for this date to receive citizens' comments regarding a request from Greg Norris for a Special Use Permit for a private horse training facility to be located at 9737 Norton-Coeburn Road.

There was no opposition to the proposed Special Use Permit.

There being no further comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING/SPECIAL USE PERMIT/ADULT ASSISTED LIVING FACILITY

Chairman Stallard noted that applicant Judy Hamilton has withdrawn her request for a Special Use Permit for an adult assisted living facility to be located at 14510 Sandy Ridge Road because the land would not perk for a septic system.

 

IN RE:  PUBLIC HEARING/ SPECIAL USE PERMIT TELECOMMUNICATIONS FACILITY/CELLULAR TOWER

A public hearing was duly advertised for this date to receive citizens comments regarding a proposed Special Use Permit for a telecommunications facility/cellular tower to be located on Roy Boatright's property off Route 58 east of Coeburn approximately mile from the Coeburn exit.

Peter Caramanis, Attorney for Alltel Communications, Inc.  He stated that this application is for a 250 ft. tower located in the Coeburn area to meet the many demands from the Alltel customers. This tower would provide coverage for Alltel as well as providing opportunities for other wireless providers to use the same tower, which in turn will minimize the need for more towers.  This tower is consistent with the goals of the Zoning Ordinance and is located in a remote area that will not impact residences.  He noted that the Planning Commission has given a unanimous recommendation to approve this request.

There being no further comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING/SPECIAL USE PERMIT/FAMILY CEMETERY

A public hearing was duly advertised for this date to receive citizens' comments regarding a request from Deborah Meade for a Special Use Permit for a family cemetery (one-half acre) to be located at 10906 Highland Avenue of the Bold Camp section of Pound.

There was no one to oppose the proposed Special Use Permit.

There being no further comments, the public hearing was closed.

 

IN RE:  PUBLIC HEARING/SECONDARY ROADS SIX-YEAR IMPROVEMENT PLAN

A joint public hearing between the Wise County Board of Supervisors and the Virginia Department of Transportation on the proposed revision of the Secondary Roads Six-Year Improvement Plan has been duly advertised to receive citizens' input on the prioritizing of projects included in the first year's budget of this FY 2004-05 plan.

Highway Resident Engineer T.G. Branson stated that there will not be a debate on the merits or needs of any given project.  The first five years are in place with funding, planning, design, and R-O-W activities.  After the public hearing, the Plan will be completed and presented to the Board for approval.  Mr. Branson said there will be approximately $600,000 from which one or two more projects may be added to the Plan.

Mr. Branson reviewed each item in the Plan with an explanation of each.   

Edgar Mullins asked that the Low Water Bridge on Rt. 666 be put back into the Six-Year Plan.  He further asked that the intersection of Rt. 633 & Business 23 that is located in a curve at the mouth of Bold Camp be corrected for safety purposes.

There being no further comments, the public hearing was closed.

 

IN RE:  PUBLIC EXPRESSION

There was no one to speak during public expression.

 

IN RE:  ROADS & HIGHWAYS

Mr. Branson informed the Board that the Primary and Interstate Allocation hearings have been rescheduled for October 21 in Richlands.

Chairman Stallard directed the County Administrator to prepare a letter listing the County's road needs such as the Coalfield Expressway, Route 58 from Ramsey section of Norton to Tacoma, and construction of a crossover at the Adams Elementary School.

Board members presented needs in their districts for Mr. Branson to review.

Betty Cornett asked that the Board place the naming of a bridge in the Butcher Fork area on the agenda at the November meeting for consideration.

 

IN RE:  CONSENT AGENDA

Chairman Stallard reviewed the following items on the consent agenda:

1) Second Quarter Appropriations

2) Set public hearing on proposed ordinance amending Chapter 14 of the County Code (Massage Parlors, etc) providing an exemption from the opposite sex ban for a licensed massage therapist (6:00 pm - Nov. 6) (requested by Supervisor Cornett)

3) Set public hearing on thirty (30) proposed E-911 road names (6:00 pm-Nov, 6)

Budget Amendments

1) No, 11:  Add $99,863 in grant funding for the Department of Social Services; distributed among various line items

Transfers from the contingency reserve for emergencies line item

1) $11,000 to Legal Services, professional services other line item

2) $ 4,300 to Treasurer, professional services other line item

 

IN RE:  OTHER ITEMS REVIEWED

1) Special Use Permit for a recycling/junkyard business to be located at 2314B Preston Road in Big Stone Gap (To be deleted from agenda until next month for further land study)

2) PSA changes to the Riverview Sewer System Memorandum of Understanding (Be deleted until next month for further information

3) Appointments

4) Fiscal Status Report (Available October 9)
