Board of Supervisors - August 25, 2009 Recessed Meeting

The Wise County Board of Supervisors met in a Recessed meeting on Tuesday, August 25, 2009 at 6:00 p.m. in the Board of Supervisors meeting room located in the Wise County courthouse.  The following were present:

Chairman Robbins stated that this being a recessed meeting, the public expression period has been closed.  However, since there are several citizens that have come to speak with the Board, he would allow them to speak with limited remarks.


Terry Collier, Co-owner of Mountain Meadow, Inc, Rod Stidham, owner of Bear Creek Subdivision, Monroe Robinette, owner of Berry Hills Subdivision, all voiced their concerns regarding the proposed $7,500 sewer hook up fee with the Town of Wise.

Terry Collier, Co-owner of Mountain Meador, Inc., a subdivision of 60 lots, voiced his concern regarding the $7,500 fee for sewer and water connections for the Town of Wise.  This fee will impact the sell of their lots.  He was with the understanding that the County would be paying this fee.

Ron Stidham, owner of Bear Creek Subdivision, told the Board that he had paid for the installing of the water & sewer line to his subdivision, turn it over to the Town of Wise for maintenance and operation with the assurance that he had water and sewer for his subdivision.  He felt the fee of $7,500 unfair and it would have an impact on the housing industry as a whole.

Monroe Robinette, owner of Berry Hills Subdivision of 77 lots, said he was with the understanding that he had approval for water and sewer to his subdivision at the time his paper work was completed.  He only became aware of the $7,500 charge this week when he made an application for a sewer hookup in Berry Hills Subdivision.  This fee will have a tremendous effect on building in Wise County.  The ramifications of a $9,000.00 sewer hookup will cause people not to build.  He asked the Board to reconsider this $7,500 charge.

Nathaniel Maggard, Contractor, told the Board that he was not financially able to afford the $7,500 that is called a facility fee, not a sewer hook up fee.  This will have a huge impact on those that are on low income and senior citizens.  This will have a “snow ball affect” across the County in the other towns when they realize that the County is subsidizing the Town of Wise for sewer connections.  He asked the Board to consider re-negotiating the fee or at least asked for an exemption for those that have already paid for water and sewer, the churches, and those on fixed income.  Mr. Maggard asked the status of those building permits that are on hold at this time.

Bill Skeen stated that the investment that is being made in sewer outreach in Wise County is very expensive and in his opinion $7,500 for water and sewer connections is fair considering the price that is being paid by the County to get the sewer to its citizens.

Cecil Cantrell told the Board that he has a set of footers in Robinette’s Circle with appropriate building permits in late February or first of March and is unable to get the water and sewer taps to continue with his building.  Since he owns other lots in subdivisions in the County, he asked the Board to proceed quickly and come to some solution for the water and sewer connections.  


A motion was made by J. H. Rivers, seconded by Bob Adkins, to appoint Carl R. Snodgrass as the Enterprise Zone Administrator.  The motion was unanimously approved.


Supervisors Bates asked that the appointment to the Wise County Tourism Committee be tabled until the September meeting.


The Board took a brief recess at 6:35 p.m.

The meeting reconvened at 6:50 p.m.


A motion was made by Dana Kilgore, seconded by Ronnie Shortt, to go into closed session as permitted by the Code of Virginia per the following code sections:

  • Section 2.2-3711(A)(6) Investing of Public Funds

  • Section 2.2-3711(A)(7) Legal Matters

The motion was unanimously approved.

After a lengthy closed session, a motion was made by Bob Adkins, seconded by Steve Bates, to reconvene the meeting.  The motion was unanimously approved.


Secretary Underwood read the certification for closed meeting.

A motion was made by Ronnie Shortt, seconded by J. H. Rivers, to approve the resolution verifying matters discussed while in closed session.  The motion was unanimously approved.

Chairman Robbins directed Attorney Mullins to meet with the Town of Wise to discuss the concerns that have been raised by several citizens that came to the Board meeting and ascertain whether or not some arrangements can be made regarding those concerns.


A motion was made by J. H. Rivers, seconded by Bob Adkins, to recess the meeting until 5:00 p.m. on Thursday, September 3, 2009.  The motion was unanimously approved.
