Kenny Robinson, representing VDOT in the absence of Resident Engineer T. G. Branson, gave a brief update on VDOT construction throughout the County.

Mr. Robinson reviewed the following proposed resolutions:

·         Resolution Abandoning Certain Sections of Rt. 621

·         Resolution Abandoning Certain Sections of Rt. 638

·         Resolution Abandoning Certain Sections of Rt. 612

IN RE:  HANDS ACROSS THE MOUNTAIN

Stan Botts, Co-chairman of Hands Across the Mountain, addressed the Board regarding the proposed Black Mountain Scenic Overlook Project. Several years ago, Hands Across the Mountain received $150,000 in federal transportation enhancement grant funds to build the scenic overlook. Since that time, negotiations have been ongoing with Penn Virginia, the owner of the property on which the overlook would be constructed, in deeding the property to VDOT. Mr. Botts noted that the deadline for receiving this grant is close at hand and he has asked for an extension of one year with no response to date.

In the original proposal, VDOT would build and design the overlook but Penn Virginia would hold the mineral rights for the property.  However, VDOT could not accept the property unless there was some assurance of protection from future mining. Even though there was no intent to mine the property, VDOT could not accept the deed unless the language regarding the mineral rights was removed.   

Since VDOT could not accept the property, the County has been asked to accept ownership. Mr. Botts stated that the plans have been for a picnic type setting with tables, fencing of the overlook, and paving for parking with no electricity required.

There was some discussion on liability, who would be responsible for maintenance and upkeep of the property. 

IN RE:  PUBLIC HEARING/CONDITIONAL ZONING PERMIT/JOYEL MULLINS

A public hearing has been duly advertised for this date to receive citizens comments regarding a request from Joyel Mullins for a conditional zoning permit for property located on Cranes Nest Road for the purpose of establishing an auto repair shop and store.

There were no public comments regarding the proposed conditional zoning permit.

The public hearing was closed.

IN RE:  PUBLIC EXPRESSION

There was no one to speak during public expression.

IN RE:  CONSENT AGENDA

The following items were reviewed:

• Set public hearing 6:00 p.m. September 2, on a proposed ordinance approving the exemption of Blue Ridge Public Television from Certain Taxation
• Set public hearing 6:00 p.m. September 2, on a proposed Solid Waste Management Plan for Wise County
• Set public hearing 6:00 p.m. September 2, on new E-911 road name additions
• Resolution requesting the Wise County IDA to explore a Venture Park with the University of Virginia's College at Wise
• Resolution designating the County Administrator as Applicant's Agent for the State Homeland Security Grant Program
• Budget Amendment

No. 2:  Increase General Fund revenues by $10,000 (Adelphia grant to Towns); deposit in Channel 97 line item in Non-departmental portion of the General Fund Budget

• Transfer from reserve for emergencies/contingency

   $26,676 to DSS; amount for CSA less than projected/budgeted

IN RE:  OTHER ITEMS REVIEWED

• Request from Treasurer to continue with the DMV Stop administrative charges; proceeds to be used for part-time position, etc.
• Resolution supporting grant application to the Tobacco Commission to provide funding for the Virginia Cooperative Coyote Control Program.
• Consider School Board request for $339,400 set aside in County's Capital Improvements Fund
• Award bids: 1)  truck knuckle boom loader with trash body; and 2) a used l997-2004 road tractor
